By submitting a nomination, or by indicating acceptance of this agreement in any other way, you agree to the Business Analyst Of The Year Terms and Conditions.
1. Background to Agreement
1.1. The rights that you have in application for the Business Analyst Of The Year (BAOTY) are set out in this agreement. You may only submit a nomination for the award if you agree to the terms of this agreement.
1.2. If you do not agree, or do not have authority to enter into this agreement, you may not submit a nomination.
2.1 The nominee must be a South African resident.
2.2 The award is open for the nomination of anyone who practices business analysis as defined in the BABOK® version 3.0, the IIBA® Competency Model version 3.0 or the PMI-PBA® Standard.
2.3 The nominee must have spent the majority of the previous 18 months (at the time of submission) practicing in the field of business analysis, either as a business analyst generalist, a specialist practitioner or a hybrid job role.
2.4 The referenced business analysis case work must have taken place within the previous 18 months.
2.5 The referenced business analysis case work must have taken place within South Africa.
2.6 Elected IIBA® South African Chapter or PMI® South Africa board members, or anyone connected directly with the award are ineligible for nomination (nominee).
3.1 Applications are accepted as self nominations (nominee) or from another person (nominator).
3.2 Only one nomination (nominee) can be made per person (nominator).
3.3 Elected IIBA® South African Chapter or PMI® South Africa board members, or anyone connected directly with the award are ineligible to submit a nomination (nominator).
3.4 Elected IIBA® South African Chapter or PMI® South Africa board members, or anyone connected directly with the award are ineligible to provide supporting references.
4.1 Each application must be submitted electronically.
4.2 The nomination form must be submitted by the closing date published for the applicable award year. Late entries will be disregarded.
4.3 All sections of the nomination form must be completed. Incomplete application forms will be disregarded.
4.4 Applications that do not meet the stated nomination requirements will be disregarded.
4.5 Application information will be retained disclosed to the assessment panels on a strictly confidential basis for the purpose of administering the South African Business Analyst of the Year Award.
4.6 Neither BCMG, nor award sponsors or partners, will be held responsible for any applications that are not received for any reason, by the closing date, whether lost, delayed, corrupted or otherwise, and whether or not due to any technical difficulties or malfunctions.
4.7 Application submissions may be withdrawn by the nominee at any time, in writing.
5.1 Valid submissions will be shortlisted against the criteria for the applicable award year.
5.2 Should the required level of excellence not be attained, the award team reserve the right to not make an award.
5.3 Regrettably, it is not possible to provide individual feedback regarding nominations.
5.4 The award teams, including the application administration, assessment committee and panel of judges, decision is final and no correspondence will be entered into before, during or after Award.
6.1 Finalists (shortlisted nominees) are required to support their application by delivering a presentation, followed by a question and answer session with the assessment panel, either in person or via video-conferencing.
6.2 Finalists who do not make themselves available to the assessment panel will be disqualified.
6.4 Prior to the award announcement, finalists shall engage in the production of a written article, to be published on BCMG platforms, promoting their BAOTY Award application.
7.1 The winner of the Business Analyst Of The Year award will be the finalist who has demonstrated the most outstanding contribution to business analysis, against the criteria for the applicable award year.
7.2 Following the award announcement, the winner shall engage in the production of a written article, to be published on BCMG website, sharing their BAOTY Award success.
7.3 During their term as BAOTY, from time to time, the winner may be required to make appearances and present at community forums and events.
7.4 In closing their term, the winner shall engage in the production of a written article, to be published on BCMG platforms, sharing their experience as BAOTY.
8. Media and Marketing
8.1 Nominee, nominators, finalists and companies may be contacted to contribute towards articles, case studies, press releases and other industry publication regarding their story.
8.2 You agree that BCMG, award sponsors and partners may use the nomination content, statements, presentations, interviews, photographs and other application content for general media advertising and marketing.
8.3 You agree that BCMG, award sponsors and partners may publish material, together with your name, role and company (including images and logos), in printed material and on digital platforms [and on any successor platforms – print and digital – that may operate from time to time], on such page and in such position as we may determine in our sole discretion.
8.4 You agree that BCMG, award sponsors and partners may edit content, endorsements and testimonials, and publish edited or partial versions of such. However, we will never edit a testimonial in such a way as to create a misleading impression of your views.
9.1 BCMG, award sponsors or partners are not liable for any costs incurred by nominees, nominators or any other party in their application.
10. Force Majeure
10.1 Neither party will be liable for any delay in performing or any failure to perform any obligations under this Agreement due to any cause beyond their reasonable control, including but without being limited to any of the following: strikes, lock outs or other industrial action, sabotage, terrorism, civil commotion, riot, invasion, war, threat of or preparation for war, fire, explosion, failure of electrical supply, storm, flood, subsidence, epidemic or other natural physical disaster, impossibility of the use of railways, shipping aircraft, motor transport or other means of public or private transport; any act or policy of any state or government or other authority having jurisdiction over either party, sanctions, boycott or embargo.
